These terms are the agreement between you and [Company name], an Estonian private limited company, registry code [Registry code], address [Address], for the Gems & Lemons journal. Contact: [Contact email].

The journal

Gems & Lemons is a private journal of places, follow-ups, dates, trips, and notes. A Gem is a place you would go back to. A Gemlem is neither bad nor a favourite. A Lemon is a place you would not. The journal is not a public review and not a chat.

The account

You need an account. You must be at least 16. You give a true email address and you keep the password to yourself. You are responsible for what is done with the account. One person, one account.

What you write

You may keep places, follow-ups, dates, trips, and notes, and you may attach a file to your own entry. You decide what to write. The journal does not check that a place, a date, or a note is accurate.

Sharing

You may send a card to a circle you choose: Family, Friends, Other, Work, or the Gem Community. A circle you join is not your circle. A card you send does not give you a card in return.

A Lemon and a Gemlem are not sent to Work or to the Gem Community. A follow-up goes to Family only. A date may go to Family, Friends, and Work. A shared card is text. A photo or a PDF stays on your entry and is not part of the card.

A person who receives a card may send one short line back, of no more than 40 characters. That line is not a conversation. No alert is sent by email.

You may rename a circle. The limits on what that circle can receive do not change.

What you must not do

You must not use the journal for sexual content involving a child, for planning violent crime, or to break the law. You must not send a photo or a PDF inside a shared card. You must not try to read another person’s journal, or pretend the journal is a public rating of a business.

Your words

You keep the right to what you write. You allow us to store it in Singapore and to show a card only to the circle you chose. A Gem you send to the Gem Community may be counted by place name, street, city, number of Gem visits, and number of people. That count does not include your note or your name. If you delete the account, that permission ends, except for a record a lawful order already requires us to keep.

If we suspend an account

We may suspend or close an account that breaks these terms. If a report concerns a child or a threat of violence, we may keep the card and notify the police, and we need not write to the sender first. The privacy policy says what we read and what we do not.

Privacy

The privacy policy is part of these terms. The journal is stored in Singapore. There is not a second copy.

Price

Until a price is shown in the journal, the account is free within the limits shown there. A paid plan is charged by the payment service at the price shown at the time you pay. The choices are a month, a year, or one payment for five years. The first year is the full price. If you stay, the following years are 10 percent less, rounded to the whole dollar. The five-year payment does not receive a further reduction. You may cancel a repeating plan. The time already paid is not refunded, except where the law requires a refund. After you cancel, the account returns to the free limits.

Ending

You may delete the account at any time. We may stop the journal by giving notice in the app. If we stop it, we give you a way to take a copy of your journal first, unless the law forbids that.

The service may fail

We work to keep the journal available. We do not promise that it will be available at every moment, or that a note cannot be lost. Keep a copy of anything you cannot afford to lose.

Liability

We are responsible for a legal duty that cannot be excluded, including a duty to a consumer in the country where you live. Apart from that, we are not liable for a lost note, a missed date, or a decision you make from what you wrote. Our liability for a paid period is limited to the amount you paid us for that period.

Which court

Estonian law applies to these terms, together with rights under European law that cannot be signed away. The courts of Estonia are the company’s home courts. You may still use a court in the country where you live where the law gives you that right.

Language

These terms are written in English. If they are shown in another language, that text is a translation made for convenience, including a translation produced automatically. If the two texts differ, the English text is the one that applies.

Changes

If these terms change, the date below changes and the journal will say so. If you continue to use the journal after that date, the new terms apply. If you do not agree, delete the account.
